The band was formed in late 2007 by Patrick Kennison (Union Underground), Marty O'Brien (Disturbed, We Are the Fallen) and session drummer Chad Clark to film a video for Kennison's song "The Laughing Dead".

He co-founded Union Underground who played on Ozzfest 2001 and released an album An Education in Rebellion which sold 350,000 copies.

The Union Underground sold more than 5,000 copies of their self-recorded/produced 1997 selftitled album and were noticed by a Columbia A&R exec, John Weakland, who later signed them to Columbia Records.

In March 2002, The Union Underground released the song "Across the Nation" which was used by the World Wrestling Federation, now known as World Wrestling Entertainment as the theme song for their RAW brand until October 2006.
