However, for most of the year 1921, Swann remained out-of-state, partly in Florida, partly in Missouri, and left the office in the hands of his Chief Assistant D.A. Joab H. Banton.
He graduated LL.B. from Fordham Law School in 1911, was admitted to the bar in 1912, and practiced in New York City, at times in partnership with Ferdinand Pecora and Joab H. Banton.
On December 6, 1888, he married Jessica Augusta Baldwin, and their son was Nellson Olcott, who became an Assistant District Attorney under Edward Swann and Joab H. Banton.
