In his judgement, Justice Kan Ting Chiu noted that Tochi might not have known that the capsules contained diamorphine.
He joined the Singapore Legal Service in 1970 and was appointed State Counsel at the Attorney-General's Chambers.

Kan was the judge in the trial of Iwuchukwu Amara Tochi for drug-trafficking, which resulted in the latter's execution by hanging.

Since 1999, Kan has also served as Chairman of the Singapore Academy of Law's Legal Heritage Committee.
