Seven months previously, in the case of Hinton v. Donaldson, the Scots Court of Session had ruled that copyright did not exist in the common law of Scotland, so that Alexander Donaldson (an appellant in Donaldson v. Beckett with his older brother, John) could lawfully publish Thomas Stackhouse's New History of the Holy Bible.
The earliest recorded use of the term "synarchy" is attributed to Thomas Stackhouse (1677–1752), an English clergyman who used the word in his New History of the Holy Bible from the Beginning of the World to the Establishment of Christianity (published in two folio volumes in 1737).
The son of John Stackhouse (d. 1734), who became rector of Boldon in County Durham, and uncle of John Stackhouse, he was born at Witton-le-Wear where his father was then curate.
