After Jesse Tabish quit the band, and with the additions of Mike Kennerty and Chris Gaylor, The All-American Rejects were picked up by Doghouse Records, and later DreamWorks Records, finally with the current major label of Interscope Records.

"Gives You Hell" was written by Nick Wheeler and Tyson Ritter in Vancouver, Canada on a secluded writing trip for the band's third studio album, and recorded at George Lucas's Skywalker Ranch studios in California.
In Rabun County, "Fallin' Apart" was experimented with and played around with before achieving the final product, a process described by singer/bassist Tyson Ritter as "Old School".
