Kerr was a grandson of Lord Charles Lennox Kerr, fourth son of William Kerr, 6th Marquess of Lothian.
It appeared in a Dutch bookseller's sale catalogue of 1759 and was then lost until 2010, when it was rediscovered by Andrew Woolley in the papers of Lord Robert Kerr (?-1746), the son of William Kerr, 3rd Marquess of Lothian, now in the National Archives of Scotland.
He was appointed secretary of state in 1649 and was one of the commissioners sent by the Scottish Parliament to protest against proceeding to extremities against the king.
He succeeded to the Marquessate of Lothian in 1722 and was elected a representative peer in 1731, sitting in the House of Lords until 1761.
