Toner had a race to be fit for the opening day of the 2009–10 football season after having problems with his ear drum in Rochdale's pre-season training camp in Marbella before suffering from shin splints which made him miss the rest of Rochdale's pre season matches.

Mr. Toner joined Wiley Rein in 2011, after leaving Bryan Cave LLP where he was a partner for four years and was also president of Bryan Cave Strategies, which was Bryan Cave’s government affairs division.
He has had a number of distinguished students in the field, including Martha McClintock at the University of Chicago, Elizabeth Adkins-Regan at Cornell, Avery Gilbert, Jack Yanovski, Stephen Zoloth at Northeastern, Penny Bernstein at Kent State University, Joseph Anisko, Rodney Pelchat, Karen Stewart, and James Toner.
Toner was expected to face Leonard Garcia on December 4, 2010 at The Ultimate Finale 12, but after Garcia was rescheduled to fight Nam Phan, Ian Loveland stepped in to face Toner.
Debuting featherweights Brandon Visher and Tyler Toner were scheduled to face each other at this event, but Toner was removed from the event and replaced by fellow WEC newcomer Courtney Buck.
