In the wake of the military coup which deposed the Qarase government on 5 December 2006, Matanitobua was sent on paid leave until further notice, along with Chief Justice Daniel Fatiaki, on 3 January 2007.
On 15 June 2006, Chief Justice Daniel Fatiaki, as president of the Supreme Court, reduced Vakalalabure's prison sentence from six years to four, finding that others convicted with him had received lesser sentences.

The substantive Chief Justice Daniel Fatiaki, had asked the then President of the Court of Appeal Justice Gordon Ward, to "hold the fort" for the judiciary as a de facto Acting Chief Justice.
The present Chief Justice is Anthony Gates, who succeeded Daniel Fatiaki following the military coup that deposed the Qarase government on 5 December 2006, when Commodore Josaia Voreqe (Frank) Bainimarama, the Commander of the Republic of Fiji Military Forces and Acting President of Fiji, sent Fatiaki on leave.
The Society condemned what it saw as interference in the Judiciary by the military-backed government, after Chief Justice Daniel Fatiaki and Chief Magistrate Naomi Matanitobua were sent on forced leave on 3 January 2007, and Anthony Gates sworn in as Acting Chief Justice on 16 January.
