In exchange for pleading guilty to a minor charge, she averted being prosecuted for the major offenses but agreed to serve as a witness for the office of U.S. Attorney Jim Letten.
Jim Letten, the U. S. Attorney for the Eastern District of Louisiana, vowed his office would take "as much time and resources as necessary" to resolve the case.
After finishing his law degree at the Tulane University School of Law, Letten worked for Orleans Parish District Attorney Harry Connick, Sr. for four years and then began his career as a prosecutor for the U.S. Department of Justice.

Nonetheless, when Republicans lost the Presidency to Democrat Barack Obama in 2008, many Democrats, including U.S. Senator Mary Landrieu, took the unusual step of urging the new President to ignore partisan labels and reappoint Letten.
On June 27, 2013, President Obama nominated Polite to be United States Attorney for the Eastern District of Louisiana for a term of four years, the office having been vacated by Jim Letten, who resigned on December 11, 2012.
