With pressure from former Arizona Superintendent Tom Horne, who felt the courses were breaching HB 2281, and after TUSD issued an appeal stating otherwise, Superintendent John Huppenthal deemed the course to be disbanded or TUSD would lose funding.
He banned state funding for ethnic studies programs, resulting in the Tucson School District having to remove numerous books from the curriculum in January 2012, including William Shakespeare's The Tempest.

Huppenthal was elected Arizona Superintendent of Public Instruction in the 2010 state election.
