The MTA and the Transport Workers Union, led by Roger Toussaint, were negotiating to settle a new contract.
•
At a news conference on the evening of December 27, 2005, Roger Toussaint announced an agreement with the MTA calling for no change in the pension, 3%, 4%, and 3.5% annual salary increases for the next three years respectively plus a 1.5% of salary cost to workers to help defray health care costs.
He is also the half-brother of Roger Toussaint, the president of Transport Workers Union Local 100.
Both the MTA's attempts to negotiate pension benefits for public employees as well as the strike were illegal, as they were in violation of New York State's Taylor Law.
Following a 2005 strike, Transit Workers’ president Roger Toussaint was incarcerated for three days as per a Taylor Law ruling.
