Governor Rendell nominated Allegheny County Common Pleas Judge Cynthia A. Baldwin to temporarily fill the vacancy through January 2008.

The ousting of Justice Nigro was the direct result of public anger over a pay raise for members of all 3 branches of state government, which the General Assembly passed without public notice or debate in the early morning hours of July 7, 2005 and then-governor Ed Rendell quickly signed.
Justice Russell M. Nigro received a majority of "NO" votes in the election of 2005 and was replaced by Justice Cynthia Baldwin, who was appointed by Governor Rendell in 2005.

By date of ordination, he is currently the fourth senior member of the Quorum of the Twelve Apostles, preceded by Russell M. Nelson, L. Tom Perry, and quorum president Boyd K. Packer.
Prior to doing so, he received a PhD in Modern European History from Vanderbilt University, was a Fulbright-Hays Research Fellow in Italy, taught modern European history at Stanford University, and served as an officer in the California Army National Guard.
In 1995 Nelson went to Beijing, along with Neal A. Maxwell and other LDS Church leaders, on an official invitation of Li Lanqing who at the time was Vice Premier of China.
During 1986-1987 he served as Acting Associate Director of the Ohio Supercomputer Center, cofounding the center and the Ohio Academic Resources Network.
