Justice John Walpole Willis was appointed the first Resident Judge by Governor George Gipps, largely to provide some measure of peace within the judicial establishment, Willis having been engaged in a number of acrimonious conflicts with his fellow judges in Sydney.

Following the official opening up of settlement in the district, Captain William Lonsdale was appointed as police magistrate, and held the first local court sittings within the District.

In 1840, a Port Phillip division of the Court was created, consisting of a single Resident Judge, to exercise the court's jurisdiction in the Port Phillip District of the Colony of New South Wales.
