The Wyoming Supreme Court upheld the law in a June 2008 ruling, and in April 2009 NIU relinquished its Wyoming registration and announced plans to merge with Newport University in California.
Twelve years later, two state legislators challenged the term limit law in a lawsuit; the Wyoming Supreme Court invalidated the limits in a unanimous decision, ruling that a constitutional amendment would be required to establish such a law.
