Soon after the death of archbishop Romilli the Austrian Empire was defeated in the Second Italian War of Independence and the new Italian government refused to recognize Ballerini as archbishop of Milan, so Caccia Dominioni was forced to assume the duty of archbishop of Milan.

The events of the years 1859 and 1860 stiffened Caccia Dominioni who refused to celebrate a Te Deum for the birth of Italy, in reaction for this decision many clergy of the archdiocese together with many lay people forced Caccia Dominioni to escape in his family residence in Cornate d'Adda and later in Monza.
